The Brady Campaign has lost its third case challenging the constitutionality of the Protection of Lawful Commerce in Arms Act (PLCAA) as the U.S. Supreme Court rejected Brady's appeal in Adames v. Beretta U.S.A. While the case involved a tragic child shooting, the product involved was not dysfunctional and therefore the manufacturer is not to blame by law. The PLCAA was passed in 2005 by Congress in response to the flood of reckless lawsuits like this one that were brought against the firearms industry.
